I (Buyer, Member, Parent, Spouse, or Guest, as applicable) agree that if I engage in any physical exercise or activity on the center’s premises (4POINT BASE ACADEMY, hereinafter 4POINT BASE, LLC), I do so at my own risk. This includes, without limitation, use of the equipment, locker room(s)/bathroom(s), shower(s), all portions of the premises, parking or sidewalk, and my participation in any activity, class program, or instruction now or in the future made available. I understand that there is a possibility of serious injury during training and other activities at 4POINT BASE, LLC and its associated programs such as BJJ, Women’s Self Defense, Kid’s Core Fitness/ “Base It” training programs. I agree to adhere to all the rules and regulations set forth by 4POINT BASE, LLC which relates to following all COVID-19 rules set forth by the state of OH and 4POINT BASE, LLC to help keep the areas within, sanitary, clean and safe above all standards including regular temperature checks and mask wearing when required. I hereby assume all risks of any injury, death and damages, howsoever and wherever occurring, to myself and to the minor for which I am guardian. I will not hold 4POINT BASE, LLC, or any of its agents, independent contractors, directors, instructors, coaches, owners, volunteers, affiliates or employees liable for any injuries or damages should they occur. I am fully aware and understand the full benefits of consulting a doctor before beginning any type of exercise program. I will also stay home for my continued safety and the safety of others if I do not feel well in any capacity, specifically when related to COVID-19 symptoms (please refer to the CDC website at www.cdc.gov for the latest updates and guidelines)
I agree not to videotape while classes are in session without prior consent of instructor. Pictures are allowed and may also be used for advertising purpose to help promote the Academy.
I ACKNOWLEDGE THAT I HAVE CAREFULLY READ THIS WAIVER AND RELEASE AND FULLY UNDERSTAND THAT IT IS A RELEASE OF ALL LIABILITY, IN ADDITION, I DO HEREBY WAIVE ANY RIGHT THAT I MAY HAVE, BY OR ON BEHALF OF MYSELF, MY SPOUSE OR ANY CHILD (MINOR OR OTHERWISE), TO BRING LEGAL ACTION OR ASSERT A CLAIM FOR INJURY OR LOSS OF ANY KIND AGAINST 4POINTBASE, LLC OR SERVICE YOU PROVIDE AS DESCRIBED IN THIS PARAGRAPH OR ON ACCOUNT OF ANY ILLNESS OR ACCIDENT, OR DAMAGE TO OR LOSS OF MY PERSONAL PROPERTY.
Please accept this as my contract with you for the practice and study of martial arts and its related programs.
